Licence Terms and Conditions

The photos and images of the Zillertal image database are made available for download by Zillertal Tourismus GmbH, Gewerbegebiet Nord 1, A-6262 Schlitters, Austria (hereinafter referred to as “ZTG”) in accordance with the following Licence Terms and Conditions.

1. Authorised Persons and Authorised Purposes

1.1 Licence for Official Use to Media Companies

ZTG shall grant holders of commercial media (newspapers, journals, television broadcasters and operators of online media) a free, non-exclusive and non-transferable Licence for Official Use (Werknutzungsbewilligung) to copy, distribute, make available and submit the photos and graphics of the Zillertal image database within the framework of editorial utilisation or reporting on topics having a thematically relevant connection with the Zillertal, which may be revoked at any time. Any previous inquiry to ZTG shall not be necessary in this context.

1.2 Licence for Official Use to Entrepreneurs in the Field of Tourism

ZTG shall grant entrepreneurs in the field of tourism a free, non-exclusive and non-transferable licence for official use to copy, distribute and make available the photos and graphics of the Zillertal image database within the framework of reporting on topics having a thematically relevant connection with the Zillertal, as well as for promoting tourism offers within and outside the Zillertal, which may be revoked at any time. Any previous inquiry to ZTG shall not be necessary in this context.

1.3 Download and Use of Images by Other Persons and/or for Other Purposes

Any use and exploitation of the images and graphics deviating from or going beyond the purposes outlined in Sections 1.1 and 1.2, in particular also their processing, shall require the prior express and written approval of ZTG. Any previous inquiry is to be made in writing to marketing@zillertal.at.

1.4 The images or graphics of the image database of ZTG may not be used in such a way that is likely to damage the reputation and prestige of ZTG, the tourism goals or any other public or private organisation or its members or bodies.

1.5 Furthermore, the images and graphics of the image database may not be used for any commercial purposes going beyond those stipulated in Sections 1.1, 1.2 and 1.3, that means, images or graphics from the image database of ZTG may not be part of any merchandising article or any product intended for sale (e.g. t-shirt with image or graphic from the image database of ZTG) or for any other advertising purposes than those stipulated in Sections 1.1, 1.2 and 1.3 (e.g. image or graphic from the image database of ZTG in an advertising brochure). For the purposes mentioned in this Section 1.5, the prior written approval of ZTG must be obtained.

2. Designation of Authorship and Other Information

Unless otherwise stated on the download page, the photos and graphics of the Zillertal image database are to be provided with the designation of authorship “Zillertal Tourismus GmbH”. In so far as the place the photo was taken and/or the name of the photographer or author can be seen on the download page, this information, too, is to be provided.

3. Exclusion of Warranty and Liability, Responsibility of the User

3.1 ZTG shall not grant any warranty with regard to and in connection with the provision of the photos and graphics of the Zillertal image database and the associated royalty-free granting of licences for official use (Section 1).

3.2 Any liability of ZTG for slight negligence shall be excluded. The existence of gross negligence on the part of ZTG is to be proven by the respective injured party.

3.3 The user shall use the photos and graphics exclusively within the framework of these Licence Terms and Conditions. The user shall indemnify and hold ZTG harmless, in case any third party takes legal or extrajudicial steps against ZTG in connection with the user using the photos or graphics.

4. Applicable Law, Place of Jurisdiction

4.1 Any and all legal questions arising from or in connection with these Licence Terms and Conditions shall be governed by Austrian law, excluding any of its conflicts of law principles.

4.2 For any and all disputes arising from or in connection with this Agreement, the exclusive competence of the court having jurisdiction over the headquarters of ZTG shall be agreed upon.
